Sun IP LLC (“Company” or “we” or “us” or “our”) respects the privacy of its users (“user” or “you”) that use our website located at www.SunIP.com, including other media forms, media channels, mobile website or mobile application related or connected thereto (collectively, the “Platform”). The following Company privacy notice (“Privacy Notice”) explains the types of information that we may gather about or collect from you in connection with your use of the Platform. It also explains the conditions under which we use and disclose that information, and your rights in relation to that information. Our Platform is hosted in the United States of America and is subject to U.S. state and federal law. If your use of our Platform would be unlawful in your jurisdiction or if you do not consent to transferring your information to the United States, please do not use the Platform.

We collect, use, and are responsible for certain personal information about you. When we offer goods and services to individuals in the European Economic Area (EEA), we are subject to the EU General Data Protection Regulation (EU GDPR), which applies across the entire European Union. For California consumers, we are subject to the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA). We are responsible as a “controller” of that personal information for the purposes of the GDPR. We are responsible for your personal information as a “business” under the CCPA/CPRA.

Information We Collect

“Non-Personally-Identifying Information” is information that, without the aid of additional information, cannot be directly associated with a specific person. “Personally Identifying Information,” by contrast, is information such as a name or email address that, without more, can be directly associated with a specific person.

Personal Information (“Personally Identifiable Information” or “Personally Identifying Information” or “PII”):

We may collect or may have the following categories of information about you. In some cases, the information we collect may fall within more than one category:

  • Name
  • Address
  • Email address.
  • Telephone number.
  • Financial information such as credit card number, type, expiration date or other financial information.
  • We may also request information about your interests, activities, gender, age, birthday, username, hometown, or other demographic information, and information we consider relevant.

You are under no obligation to provide us with Personally Identifying information of any kind, but be aware that your refusal to do so may prevent you from using certain platform features.

Sources of Information

Much of the information collected by Company about users is information provided by users themselves when:

  • Registering for and using our Platform and services.
  • Participating in polls, surveys, or other features of our service, or responding to offers or advertisements.
  • Communication with us.
  • Creating a profile.
  • Signing up to receive newsletters.

How We Use Your Information

We may use or may have used the information we have about you:

  • Deliver the products or services that you have requested.
  • Manage your account and provide you with customer support.
  • Communicate with you by email, postal mail, telephone and/or mobile devices about products or services that may be of interest to you either from us, our affiliate companies, or other third parties.
  • Develop and display content and advertising tailored to your interests.
  • Resolve disputes, troubleshoot problems, measure interest in our services, inform you of updates, customize your experience, detect and protect us against error, fraud and other criminal activity, enforce our Terms of Use, and as otherwise described to you at the time of collection.

Analytics

We may use third-party vendors to provide analytics services, inform, optimize, and serve ads based on your past activity on our Platforms and applications, including MonsterInsights and Google Analytics for Display Advertising. These vendors may use Web Cookies, Web Beacons and other technologies to collect information about your use of the Platform. This information may be used by us and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on our service and other Platforms and better understand your online activity. If you do not want any information to be collected and used by Google Analytics, you can install an opt-out in your web browser

(https://tools.google.com/dlpage/gaoptout/) and/or opt out from Google Analytics for Display Advertising or the Google Display Network. You can do so by using Google’s Ads Settings (www.google.com/settings/ads).

How Your Information is Shared

We may share or disclose PII as follows:

  • With such third-party vendors that we deem necessary for facilitating the provisions of services to our clients.
  • With our authorized service providers that perform certain services on our behalf, such as fulfilling orders, providing customer service and marketing assistance, performing business and sales analysis, performing translation, proofreading, patent filing, and related services, supporting our Platform functionality, and processing credit card payments.
  • Emails from us to you about products and services that we believe may be of interest. You can opt out by using the unsubscribe link or contacting us.
  • Parties to a corporate transaction. We may transfer information we collect about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a merger, acquisition, joint venture, reorganization, divestiture, dissolution, or liquidation). Personally Identifying Information submitted or collected after a transfer, however, may be subject to a new privacy policy adopted by the successor organization.
  • Other third parties. We may disclose information we collect about you (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government officials, (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity, (iv) when disclosure of information we collect about you is otherwise required or permitted by law, or (v) with your consent.

Non-Personally-Identifying Information

We analyze Non-Personally-Identifying Information gathered from users of the Platform to help us better understand how the Platform is being used. By identifying patterns and trends in usage, we are able to better design the Platform to improve users’ experiences, both in terms of content and ease of use. From time to time, we may also release aggregated Non-Personally-Identifying Information such as by publishing a report on trends in the usage of the Platform.

Cookies

Cookies are small text files with a small amount of data, which may include an anonymous unique identifier that is stored on your computer, and that your browser provides to the Platform each time you submit a query to the Platform. We use cookies on the Platform to keep track of services you have used, to record registration information regarding your login name and password, to record your user preferences, to keep you logged into the Platform, and to facilitate purchase procedures. We also use Web Cookies to track the pages that users visit during each Platform session, both to help Company improve users’ experiences and to help Company understand how the Platform is being used. THE PLATFORM, WITH THE UNDERSTANDING THAT CERTAIN FEATURES OF THE PLATFORM MAY NOT FUNCTION PROPERLY WITHOUT THE AID OF WEB COOKIES. PLATFORM USERS WHO REFUSE WEB COOKIES ASSUME ALL RESPONSIBILITY FOR ANY RESULTING LOSS OF FUNCTIONALITY.

Web Beacons

A “Web Beacon” is an object that is embedded in a web page or email that is usually invisible to the user and allows Platform operators to check whether a user has viewed a particular web page or an email. We may use Web Beacons on the Platform and in emails to count users and to deliver co-branded services. Web Beacons are not used to access users’ Personally Identifying Information.

Third-Party Advertisers

We may use third-party advertising companies to serve ads when you visit the Platform such as Google Ads and AdRoll. These companies may use information (not including any PII) about your visits to this and other Platforms. We do not identify you to the advertiser. Opt-out information is available at http://networkadvertising.org/managing/opt_out.asp.

Mobile Devices

If you use a mobile device to access our Platform or download any of our applications, we may collect device information (such as your mobile device ID, model, and manufacturer), operating system and version information, and IP address. We send you push notifications if you choose to receive them letting you know when someone has sent you a message, or for other service-related matters. You can opt-out from receiving these types of communications by turning them off at the device level. We use mobile analytics software to allow us to better understand the functionality of our mobile software on your phone. We do not link the information we store within the analytics software to any Personally Identifying Information you submit within the mobile application.

Online Postings

We may provide areas on our Platform where you can post reviews and other information relating to your activities on the Platform. We cannot control who reads your posting or what other users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your personal information.

Changing Personally Identifying Information; Account Termination

You may at any time review or change your Personally Identifying Information by going to your account settings (if applicable) or contacting us using the contact information below. Upon your request, we will deactivate or delete your account and contact information from our active databases. We will retain in our files some personal information to prevent fraud, to troubleshoot problems, to assist with any investigations, to enforce our Terms of Use and to comply with legal requirements. Therefore, you should not expect that all your personal information will be completely removed from our databases. Additionally, we keep a history of changed information to investigate suspected fraud.

California Consumers: Your rights under the CCPA/CPRA. You have the right under the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA), and certain other rights and data protection laws, as applicable, to exercise free of charge:

  • Access: The right to request access to your Personal Information, which includes the right to obtain confirmation from us as to whether or not Personal Information concerning you is being processed, and where that is the case, access to the Personal Information and information related to how it is processed. You have the right to request this information up to two times in a 12-month period.
  • Rectify or Erase: The right to rectification or erasure of your Personal Information, which includes the right to have incomplete Personal Information completed.
  • Restrict: The right to restrict obtain a restriction of processing concerning your Personal Information, which includes restricting us from continuing to process your Personal Information under certain circumstances (e.g., where you contest the accuracy of your Personal Information, for a period enabling us to verify the accuracy of the Personal Information).
  • Object: The right to object to the processing of your Personal Information under certain circumstances, including objecting to processing your Personal Information for direct marketing purposes, or objecting to processing your Personal Information when it is done based upon legitimate interests.
  • Data Portability: The right to data portability, which includes certain rights to have your Personal Information transmitted from us to another controller.
  • Right to Opt Out of Sale or Sharing: We do not Sell or Share your Personal Information. Accordingly, we do not have a methodology for opting out of the Sale or Sharing of Personal Information.
  • Right to Limit Use and Disclosure of Sensitive personal information; and
  • Consent: Where data processing is based on your consent, the right to withdraw consent at any time.
  • Protection Against Retaliation: You have the right to not be retaliated against because you exercised any of your rights under CCPA/CPRA. This means we cannot, amount other things:
    • Deny goods or services to you.
    • Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties.
    • Provide a different level or quality of goods or services to you -or-
    • Suggest that you will receive a different price or rate for goods or services or a different level of quality of goods or services.
    • Please note that we may charge a different price or rate or provide a different level or quality of goods or service to you, if that difference is reasonably related to the value provided to our business by your personal information. We may also offer loyalty, rewards, premium features, discounts, or club card programs consistent with these rights or payments as compensation, for the collection of personal information, the sale of personal information, or the retention of personal information.

CCPA Right Request Process

When you make a request, we may require that you provide information and follow procedures so that we can verify the request and your jurisdiction before responding to it. The verification steps we take may differ depending on the request you make. We will match the information that you provide in your request to information we already have on file to verify your identity. If we are able to verify your request, we will process it. If we cannot verify your request, we may ask you for additional information to help us verify your request.

Any personal information we collect from you to verify your identity in connection with your request will be used solely for the purposes of verification.

We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information or is someone authorized to act on such person’s behalf.

California law permits California consumers to use an authorized agent to make privacy rights requests. We require the authorized agent to provide us with proof of the California consumer’s written permission (for example, a power of attorney) that shows the authorized agent has the authority to submit a request for the California consumer. An authorized agent must follow the process described below to make a request. The authorized agent must also verify his/her own identity. We will confirm the agent’s authority with the California consumer about whom the request was made.

Please note that we are not required to:

    • Retain any personal information about you that was collected for a single one-time transaction if, in the ordinary course of business, that information about you is not retained.
    • Reidentify or otherwise link any data that, in the ordinary course of business, is not maintained in a manner that would be considered personal information; or
    • Provide the personal information to you more than twice in a 12-month period.

EEA Data Subjects: Your Rights Under the EU GDPR

  • Right to Be Informed: The right to know or be notified about the collection and use of your personal information.
  • Right of Access: The right to be provided with a copy of your personal information.
  • Right of Rectification: The right to require us to correct any mistakes in your personal information.
  • Right to be Forgotten: The right to require us to delete your personal information – in certain circumstances.
  • Right to Restriction of Processing: The right to require us to restrict processing of your personal information – in certain circumstances, e.g., if you contest the accuracy of your data.
  • Right of Data Portability: The right to receive the personal information you provided us, in a structured, commonly used, and machine-readable format and/or transmit that data to a third party – in certain situations.
  • Right to Object: The right to object at any time to your personal information being processed for direct marketing (including profiling). In certain other situations to our continued processing of your personal information, e.g., processing carried out for the purpose of legitimate interests.
  • Right Not to be Subject to Automated Individual Decision-Making: The right not to be subject to a decision based solely on automated processing (including profiling) that produces legal effects concerning you or similarly significantly affects you.

Children's Privacy

The Children’s Online Privacy Protection Act (“COPPA”) protects the online privacy of children under 13 years of age. We do not knowingly collect or maintain personal information from anyone under the age of 13, unless or except as permitted by law. If you are a parent or guardian and you learn that your children have provided us with Personally Identifiable Information, please contact us. If we become aware that we have collected Personally Identifiable Information from a child under 13 without verification of parental consent, we take steps to remove that information from our servers.

Security

The security of your personal information is important to us, and we strive to implement and maintain reasonably, commercially acceptable security procedures and practices commensurate to the nature of the information that we store, in order to protect it from unauthorized access, destruction, use, modification, or disclosure.

However, please be aware that no method of transmission over the internet, or method of electronic storage is 100% secure and we are unable to guarantee the absolute security of the Personally Identifiable Information we have collected from you. You use the Platform at your own risk.

Data Retention

We will retain your information for as long as is needed to provide you with the Platform’s services, for valid business purposes, and as necessary to comply with our legal obligations, resolve disputes, defend our legal rights, and enforce our agreements.

Links to Other Websites

The Platform may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third party’s website. We strongly advise you to review the Privacy Notice of every website you visit. We do not endorse or sponsor any other third-party websites. We have no control over, and assume no responsibility for the content, privacy policies, or practices of any third-party website or service.

Changes to This Privacy Notice

This privacy notice was published on September 27, 2018, and last updated on May 12, 2024. We reserve the right to modify this privacy notice at any time and in our sole discretion. Each time you use the Platform, the current version of this privacy notice will apply. Your continued use of the platform will constitute binding acceptance of those changes.

Do Not Track Policy

This Platform does not respond to “Do Not Track” signals or mechanisms.

Enforceability

In the event that any part of this Privacy Notice is declared by any court or other judicial or administrative body to be null, void, or unenforceable, said provision shall survive to the extent it is not so declared, and all other provisions of this Privacy Notice shall remain in full force and effect.
